When to Say ‘Enough is Enough’

RESULTS: We were engaged as outside strategists to review the options of continuing a business plagued by lawsuits and regulatory encumbrances. We recommended to sell the entity; those actions yielded capital, cessation of the legal challenges over time and allowed the owners to focus on new opportunities.

CHALLENGE: A multi-generation agricultural business had legal, environmental and financial commitments colliding over a period of years. As a multi-generational entity in a close-knit community sometimes the experienced and ‘distanced’ third-party (like Pontem) can make the decision process clearer and a little more tolerable. We acted not only as an extra set of eyes and rationale but also as a sounding board to the owners.

ACTIONS: The process of assembling all the legal facts through court and media records, assessing the risks of continuance based upon changes at the state and national level, along with estimating the financial impact for the future led to a conclusion that the right time to liquidate was indeed at hand.
